What it does
CG 31 31 modifies the Owners And Contractors Protective Liability Coverage Part and the Products/Completed Operations Liability Coverage Part. It excludes bodily injury or property damage that would not have occurred but for fungi or bacteria on or within a building or structure, and costs of testing, abating or remediating fungi or bacteria. Fungi or bacteria in a good or product intended for bodily consumption are excepted, as in CG 21 67.
Who needs it
Contractors and owners whose OCP or products/completed operations policies cover building work where mold claims are common.
Key provisions and limits
- "Fungi" means any fungus, including mold or mildew and mycotoxins, spores, scents or byproducts.
