What it does
CG 21 67 excludes "bodily injury" or "property damage" which would not have occurred, in whole or in part, but for the actual, alleged or threatened inhalation of, contact with, exposure to, existence of or presence of any "fungi" or bacteria on or within a building or structure, including its contents, regardless of other contributing causes. It also excludes the costs of abating, testing, cleaning up, remediating or responding to fungi or bacteria, and adds a matching Coverage B exclusion.
Who needs it
Apartment and condominium owners, property managers, builders, roofers, plumbers, HVAC and water mitigation contractors, schools and hotels.
Key provisions and limits
- The exclusion does not apply to fungi or bacteria that are, are on, or are contained in a good or product intended for bodily consumption, so food-borne illness claims are not affected.
Quoting and selling notes
- Legionella in a building water system and mold claims after water intrusion are typical uncovered losses.
- Contractors pollution policies often cover mold; offer one to remediation and building trades.
- CG 24 25 gives back limited fungi or bacteria coverage; CG 31 31 is the version for other coverage parts.
