What it does

CG 40 12 excludes injury or damage arising out of (1) the design, manufacture, distribution, sale, maintenance, use or repair of an "electronic smoking device" or any component, equipment or accessory (mouthpieces, tanks, atomizers, coils, batteries, chargers, cartridges, liquids, flavorings), and (2) exposure to vapor delivered from such a device.

Who needs it

Retailers and distributors that sell vaping products, and product manufacturers.

Key provisions and limits

  • "Electronic smoking device" means a battery-powered device delivering a vaporized inhalable substance through a mouthpiece, including battery-powered cigarettes, pipes, cigars, hookahs and vaporizers (not steam or mist inhalers).
  • Applies to the CGL and Products/Completed Operations coverage parts.

Quoting and selling notes
