What it does
CG 21 46 excludes bodily injury, property damage and personal and advertising injury arising out of the actual or threatened abuse or molestation by anyone of any person while in the care, custody or control of any insured, and out of negligent employment, investigation, supervision, reporting or retention of a person for whom an insured is legally responsible and whose conduct would be excluded.
Who needs it
Any organization working with children or vulnerable adults, and businesses such as massage, spa and transportation services.
Key provisions and limits
- In 2022 ISO introduced CG 40 28 (Broad Abuse Or Molestation Exclusion) and CG 40 29 (Sexual Abuse Or Sexual Molestation Exclusion).
Quoting and selling notes
- Many policies still carry CG 21 46 or carrier versions of it. Abuse coverage must be bought separately (sexual abuse and molestation liability, or CG 04 14 style coverage).
