What it does
CG 04 37 replaces exclusion 2.p. so that the electronic data exclusion does not apply to bodily injury or to loss of, damage to, corruption of or inability to access "electronic data" that results from physical injury to tangible property. It redefines "property damage" to include that data loss, adds a "cyber incident" exclusion for this coverage, and caps all loss of electronic data from one occurrence at the Loss Of Electronic Data Limit in the schedule (within the Each Occurrence limit).
Who needs it
Excavators who cut fiber lines, electricians and HVAC contractors working in data centers, and manufacturers whose products could damage customers' servers.
Key provisions and limits
- Electronic data is not tangible property for purposes of the policy.
Quoting and selling notes
- Ask about work in data centers, server rooms and network infrastructure.
- For data losses not caused by physical damage, a technology E&O or cyber policy is needed.
