What it does
CA 28 06 is an optional endorsement that excludes Covered Autos Liability for claims arising out of assault or battery. ISO introduced it in its 2025 multistate forms revision (CA-2025-OFR25), effective September 1, 2026 in most states (later in a few, such as October 1, 2026 in Connecticut and Kentucky and December 1, 2026 in Michigan and Rhode Island). A general liability and acts, errors or omissions counterpart for the Auto Dealers Coverage Form (CA 27 44) and an Illinois version (CA 28 07) were filed at the same time.
Who sees it
Insurers can attach it to accounts where altercations involving drivers, passengers or the public are a recognized exposure, such as taxi, limousine and shuttle operators, delivery and courier fleets, security patrol vehicles and towing and repossession operations.
Selling notes
- Read the endorsement's wording on who must commit the assault or battery and whether related negligence claims (hiring, supervision, failure to prevent) are also excluded.
- Check the client's general liability policy for its own assault or battery provisions so the gap is understood.
- Abuse or molestation is handled by a separate exclusion, CA 28 03.
