What it does
DL 98 01 provides excess personal liability above the insured's underlying homeowners, dwelling liability, auto and watercraft policies. ISO's program wraps it with endorsements that add excess coverage for specific exposures (business pursuits, home business, home day care, incidental farming, incidental occupancies, home-sharing, rideshare and delivery driving) and exclusions for designated autos, recreational vehicles, watercraft, motorcycles, motor homes, dogs, fungi and unmanned aircraft.
A new 05 26 edition is used in about 33 jurisdictions together with new companion endorsements (DL 99 69 to DL 99 74 and others), while the 02 15 edition remains in wide use.
Who needs it
Business owners and professionals with assets to protect, landlords with rental dwellings, and families with teen drivers, pools or watercraft. Commercial agents often write it next to the business's commercial umbrella because the commercial umbrella does not cover the owner's personal exposures.
Key provisions and limits
- Underwriters require specified underlying policies and limits; check the umbrella declarations and the homeowners/auto declarations together.
- Business exposures are excluded unless an excess endorsement (DL 98 03, DL 98 05, DL 99 02) is attached over a matching underlying endorsement.
Quoting and selling notes
- Schedule every residence, rental dwelling, vehicle and watercraft the client owns; gaps in underlying insurance are paid by the insured.
- For a client whose home is in a trust, add DL 98 08 (Trust Endorsement).
How the umbrella pieces fit
ISO's personal umbrella program is built from the DL 98 01 policy plus optional endorsements. The program includes excess endorsements for exposures the umbrella does not pick up on its own (business pursuits DL 98 05, home business DL 98 03, home day care DL 98 04, incidental farming DL 98 06, permitted incidental occupancies DL 99 02, broadened home-sharing DL 99 68, transportation network and delivery network driving DL 99 69 to DL 99 71), and exclusion endorsements (designated autos, recreational vehicles, watercraft, motorcycles, motor homes, dogs, unmanned aircraft). Match each excess endorsement to the underlying endorsement on the homeowners or auto policy so the umbrella has something to sit over.
Editions and availability
Current edition 05 26, replacing 02 15, 10 06, 06 98. Carriers adopt ISO editions state by state, so an in-force policy may carry an older edition.
