What it does

CX 21 93 excludes excess coverage for injury arising out of abuse or molestation as defined in the endorsement. ISO introduced it in its 2021 abuse and molestation filing with a 09 22 edition.

Who needs it

Organizations caring for or supervising children, patients, students or vulnerable adults.

How it fits the excess layer

The ISO excess form follows the provisions, exclusions and limitations of the controlling underlying insurance unless the excess form or an endorsement says otherwise. Excess endorsements therefore either add a restriction the underlying does not have, or adjust how the excess layer follows the underlying. Check every CX endorsement on a quote against the underlying policy so the layers line up.

Quoting and selling notes

  • Ask whether the underlying provides any abuse coverage; the excess will not follow it.
