What it does
CG 24 13 provides that, for Coverage B, paragraph 14.e. of the Definitions section does not apply. In the 04 13 coverage form, 14.e. is "oral or written publication, in any manner, of material that violates a person's right of privacy".
Who needs it
Insureds whose operations generate privacy claims (marketing, collections, call centers, apps, retail loyalty programs) where an underwriter adds it as a condition of coverage.
Key provisions and limits
- False arrest, malicious prosecution, wrongful eviction, defamation and advertising injury offenses remain.
Quoting and selling notes
- Privacy claims then need cyber or media liability coverage; review the client's data practices.
- See also the access or disclosure exclusions CG 21 06 and CG 21 08.
