What it does

CG 21 32 adds Coverage A and Coverage B exclusions for injury or damage arising out of the actual or alleged transmission of a communicable disease. The exclusion applies even if the claim alleges negligence in supervising, hiring, employing, training or monitoring others who may be infected; testing for the disease; failing to prevent its spread; or failing to report it.

Who needs it

Restaurants, hotels, gyms, day cares, schools, camps, senior living, salons and event venues, where outbreaks can produce claims.

Key provisions and limits

  • Applies to any communicable disease; there is no list or definition limiting it.

Quoting and selling notes

  • Food-borne illness and Legionella claims could be argued under this exclusion; explain the potential gap to food service and hospitality clients.
  • CG 33 76 is the version for other coverage parts.
