What it does
For the Employer's Liability exclusion only, CG 04 24 replaces the definition of "employee" with one stating that "employee" does not include a "leased worker" or a "temporary worker". Injury to a leased worker then falls outside the employer's liability exclusion.
Who needs it
Clients using leased employees, especially in states where leased workers can sue the client employer. In the base form, leased workers are employees and are excluded.
Key provisions and limits
- Modifies the CGL, Liquor, OCP, Pollution and Products/Completed Operations coverage parts.
- Temporary workers are already outside the "employee" definition in the base form; the key change is for leased workers.
Quoting and selling notes
- Confirm the leasing company's workers compensation covers the workers; this endorsement addresses third-party suits by them against the client.
