What it does
WC 00 03 15 (Ed. 4-84) states that the policy does not cover bodily injury to any person described in its Schedule, which has lines for farm or agricultural workers and domestic or household workers. Their remuneration is removed from the premium basis, and the insured reimburses the insurer for any payment it is required to make for their injuries.
Who needs it
The North Carolina bureau's instructions describe two uses: where the insured has elected under the compensation act not to provide benefits for farm or agricultural workers, and where it has elected not to provide benefits for domestic or household workers, in each case also removing employers liability where the insured is statutorily exempt. Workers can be described by category ("all farm or agricultural workers," "all domestic or household workers").
Key provisions
- The exclusion removes both Part One and Part Two for the described workers.
- The reimbursement clause protects the insurer if a court or agency finds the workers were covered after all.
Quoting and selling notes
- Use the exclusion only when the state's act lets the insured leave these workers outside the act; otherwise the reimbursement clause puts the cost of any claim back on the insured.
- Because employers liability is also removed for these workers, offer voluntary compensation (WC 00 03 11) or confirm that the farm liability policy addresses employee injury.
- Wisconsin's rating bureau lists WC 00 03 15 among NCCI endorsements not accepted in Wisconsin.
