What it does
WC 00 01 16 was established by NCCI Item P-1420, filed in June 2026 with a requested effective date of January 1, 2027 (edition 1-2027). It does not replace the Terrorism Risk Insurance Program Reauthorization Act Disclosure Endorsement (WC 00 04 22 C), which stays on the policy. Its purpose is notice:
- The federal terrorism backstop under TRIPRA 2019 is scheduled to expire on December 31, 2027 unless Congress acts.
- The policy covers workers compensation losses caused by acts of terrorism, including state-mandated benefits, except in Pennsylvania, where injuries or deaths from certain war-related activities are excluded from compensation coverage.
- The terrorism premium shown in Item 4 or on the WC 00 04 22 C Schedule may continue or change for new, renewal and in-force policies in effect on or after December 31, 2027, subject to state regulatory review.
Status and adoption
The Texas Commissioner of Insurance adopted Item P-1420 by order dated September 15, 2026, applying it to new and renewal policies effective on or after January 1, 2027 and to policies in force as of December 31, 2026. Minnesota's forms manual (revised May 2026) already lists the form. NCCI used the same approach for earlier reauthorizations (WC 00 01 14 for TRIPRA 2007 and WC 00 01 15 for TRIPRA 2015, both since withdrawn in Massachusetts).
Who needs it
Every policyholder; it is a disclosure, not a coverage option. The policyholder does not need to do anything.
Quoting and selling notes
- Expect questions from clients with policies that run past December 31, 2027. The endorsement states that the policy covers terrorism losses including state-mandated benefits; what it flags as subject to change is the premium charge.
- Keep the WC 00 04 22 C disclosure on the policy; this notice supplements it.
