What it is

IL 09 96 is the nuclear, biological and chemical (NBC) counterpart of IL 09 95. Its exclusion is conditional and tied to the disposition of the federal Terrorism Risk Insurance Act. If the triggering conditions occur, it excludes terrorism involving nuclear, biological or chemical means rather than all terrorism. Its schedule includes an Exception Covering Certain Fire Losses by state and coverage part, like the other ISO property terrorism exclusions.

Where it is still seen

Current property policies sometimes carry IL 09 96 01 07. One example is a 2023 policy filed in federal court with a schedule listing it next to IL 09 52 01 15.

• While TRIA remains in force, the conditional trigger generally has not occurred. Review the effect whenever the program approaches expiration or reauthorization.
