What it does

IL 02 68 replaces key parts of the Cancellation condition and adds nonrenewal and conditional renewal conditions for New York policies.

Key provisions (01 14 edition)

  • Policies in effect 60 days or less: the insurer may cancel with 30 days' notice, or 15 days' notice for the reasons that are allowed after 60 days.
  • After 60 days or on renewal: cancellation only with 15 days' notice and only for listed reasons:
    • Nonpayment of premium, with the amount due stated.
    • Conviction of a crime increasing the hazard.
    • Fraud or material misrepresentation.
    • A post-inception act or omission substantially increasing the hazard.
    • Material physical change making the property uninsurable.
    • Superintendent determinations on solvency or legal violation.
    • Probable risk the insured will destroy the property. In that case the insured may ask the Department of Financial Services to review.
  • Notice goes to the first Named Insured and to the agent or broker, with the reason.
  • Premium-financed policies get pro rata refunds, with a minimum earned premium of the greater of 10% or $60.
  • Nonrenewal and conditional renewal: written notice with specific reasons at least 60 but not more than 120 days before expiration. Conditional renewal covers changes in limits or coverage type, reduced coverage, higher deductibles, new exclusions, or premium increases over 10% not tied to exposure or rating plans. If notice is late or incomplete, coverage continues on the same terms at the lower of current or prior rates until 60 days after notice.

Quoting and selling notes

  • New York's conditional renewal rules mean that rate increases over 10% and coverage reductions need advance notice. Watch carrier compliance on renewals.
  • Commercial auto in New York uses its own cancellation form (CA 02 25).
  • An 08 26 edition replaces 01 14. It appears in a 2026 New York carrier filing for policies effective August 1, 2026 (SERFF LWCM-134943791). Compare the 08 26 notice periods and reasons with the 01 14 provisions summarized above when the carrier switches editions.
