What it does
FL 04 65 modifies the Farm Liability Coverage Form or the Commercial General Liability Coverage Form. It adds Farm Employers' Liability (each occurrence limit) and Farm Employees' Medical Payments (limit per farm employee), rated per $1,000 of payroll, with an optional extension for occurrences involving motor vehicles or autos and watercraft. The schedule can list employees to whom it does not apply, and premium can be made subject to audit.
Who needs it
Farms with hired labor in states where farm employers are exempt from workers compensation or choose not to buy it. FL 00 20 excludes injury to farm employees and employers liability.
Quoting and selling notes
Check the state workers compensation rules for agricultural employers first; where WC is required, buy it. Ask for payroll by employee type and seasonal or migrant workers (MSAWPA damages are excluded by FL 01 16). Wording reviewed: 10 06 edition.
How it fits the farm liability policy
A farm liability endorsement changes only the coverages it names (Coverage H bodily injury and property damage, Coverage I personal and advertising injury, Coverage J medical payments, or a coverage it adds). The rest of FL 00 20, including the definitions of "farming", "custom farming" and "insured location", continues to apply. When presenting a quote, list each farm liability endorsement and its schedule entries so the insured sees how the base form was broadened or narrowed.
