What it does

Form MCS-90B is the endorsement prescribed by FMCSA for passenger carriers under 49 CFR 387.39. Like the MCS-90 for property carriers, it must be in the form FMCSA prescribes, must be issued in the exact name of the motor carrier, and must provide that coverage remains in effect continuously until terminated. Its surety bond counterpart is Form MCS-82B.

Required limits (49 CFR 387.33)

  • Any vehicle with a seating capacity of 16 passengers or more, including the driver: $5,000,000.
  • Any vehicle with a seating capacity of 15 passengers or fewer, including the driver: $1,500,000.

Special rules apply to certain transit service providers operating under federal grant agreements.

Who needs it

For-hire passenger carriers operating interstate: motorcoach and charter operators, tour companies, airport shuttle and limousine services that cross state lines, and other passenger carriers that cross state lines for hire.

Selling notes

  • The limit is driven by the largest vehicle's seating capacity; adding a 16-passenger van moves the requirement to $5,000,000.
  • Interstate for-hire passenger carriers also need the insurer to file the federal certificate of insurance (BMC-91 or BMC-91X) with FMCSA.
  • Public auto policies often carry CA 24 02 Public Transportation Autos for passengers' property.
