What it does
CU 34 72 is part of ISO's 2025 umbrella endorsement filing (01 26 edition). It excludes punitive damages. Whether punitive damages are insurable at all varies by state law. Excess counterpart: CX 34 14.
Who needs it
Accounts where the carrier will not insure punitive damages, often trucking and other high-severity risks.
How it fits the umbrella
The umbrella has its own exclusions that apply whether or not the underlying policies cover the claim, and many ISO umbrella exclusion endorsements mirror a CGL or auto exclusion so that the umbrella does not drop down where the underlying is excluded. When an underlying policy carries an exclusion, check that the umbrella carries the matching CU endorsement, or explain the gap if it does not.
Quoting and selling notes
- Check whether the underlying CGL carries the matching exclusion; if the umbrella excludes what the primary covers, explain the limit gap.
- These are new filings; adoption dates vary by carrier and state.
