What it does
CG 40 50 01 26 is ISO's Exclusion – Punitive Damages endorsement. ISO introduced it in its 2025 general liability forms filing (GL-2025-OFR25), approved in most states with a January 1, 2026 effective date, so it can appear on policies written from 2026.
Whether punitive damages are insurable at all is a matter of state law; in states that allow coverage, this form removes it from the policy.
Who needs it
Contractors, trucking-related GL, hospitality and other accounts where juries can award punitive damages for gross negligence.
Key provisions and limits
- ISO's Illinois filing lists CG 40 50 as withdrawn there, so availability varies by state.
Quoting and selling notes
- Explain to the client that punitive awards would be uninsured; umbrella policies may have their own punitive damages wording.
- Compare with CG 21 76, which excludes punitive damages only for certified acts of terrorism.
