What it does

Under CG 24 03 the insurer will waive any charitable immunity of the insured in adjusting claims and defending suits, unless the insured requests in writing that it not do so. The waiver does not make the insurer liable for any amount above the applicable limit.

Who needs it

Charities, churches and nonprofit hospitals that want injured persons to be compensated rather than barred by immunity.

Key provisions and limits

  • Applies to the CGL and Products/Completed Operations coverage parts.

Quoting and selling notes

  • Discuss with the client's board: some charities prefer to keep the immunity defense.
  • Charitable immunity laws vary widely; some states have abolished it, others cap damages. Confirm the client's state before discussing the waiver.
