What it does
CG 22 78 applies to the removal, replacement, repair, enclosure or encapsulation of any hazardous material or substance from a building or structure. For those operations it deletes paragraph (1)(e) of the Coverage A pollution exclusion, the part that excludes injury or damage at sites where operations are performed to test for, clean up, remove or otherwise respond to pollutants.
Who needs it
Abatement contractors whose entire business is responding to hazardous materials.
Key provisions and limits
- Other parts of the pollution exclusion remain.
Quoting and selling notes
- Most abatement contractors buy contractors pollution liability; this endorsement narrows only one part of the CGL exclusion.
- Ask for licenses, worker training records, air monitoring and disposal procedures.
