What it does

CG 21 07 05 14 replaces Coverage A exclusion 2.p. with an exclusion for damages arising out of (1) any access to or disclosure of confidential or personal information (patents, trade secrets, customer lists, financial, credit card and health information, and other nonpublic information) or (2) loss of, loss of use of, damage to, corruption of, inability to access or inability to manipulate electronic data. Unlike CG 21 06 05 14, it contains no exception for bodily injury. A matching Coverage B exclusion is added.

Who needs it

Technology-dependent businesses, healthcare-related services and others where an electronic data failure could lead to bodily injury claims.

Key provisions and limits

  • Notification, credit monitoring, forensic and public relations costs are expressly excluded.
  • Electronic data is defined broadly.

Quoting and selling notes

  • Bodily injury caused by a data or system failure (for example an equipment control or medication record error) is excluded under this form.
  • CG 21 07 05 14 retained only in a few jurisdictions; the 12 23 data revision moved to CG 21 06 12 23 and CG 21 85 12 23.
