What it does

CA 23 94 adds a Silica Or Silica-Related Dust Exclusion For Covered Autos Exposure. Covered Autos Liability does not apply to:

  • bodily injury arising, in whole or in part, out of actual, alleged, threatened or suspected inhalation or ingestion of "silica" or "silica-related dust";
  • property damage arising out of contact with, exposure to, existence of or presence of silica or silica-related dust; or
  • any loss, cost or expense for testing, monitoring, cleaning up, removing, containing, treating or otherwise responding to silica or silica-related dust, by any insured or anyone else.

"Silica" means silicon dioxide in any form, silica particles, dust or compounds; "silica-related dust" is a mixture of silica and other dust or particles. It modifies the auto dealers, business auto and motor carrier forms.

Who sees it

Fleets hauling sand, gravel, cement, concrete and aggregates, frac sand haulers, and contractors whose vehicles generate or carry silica dust. Rating manuals list it among optional covered autos exclusions; the general liability version for auto dealers is CA 25 39.

Selling notes

Explain that dust exposure claims tied to hauling operations are excluded and check whether the CGL carries a matching silica exclusion; together they can leave the operation without coverage for silica claims.
