What it does

Intermodal equipment providers and terminals require motor carriers to sign the Uniform Intermodal Interchange and Facilities Access Agreement (UIIA) and to carry the UIIE-1 endorsement. CA 23 17 provides that the policy's auto bodily injury and property damage liability insurance applies to liability the named insured assumes as "Motor Carrier Participant" under the indemnity section (Section F.4 in the 10 13 edition) of the UIIA. Under that section the carrier defends and indemnifies the equipment provider and facility operator for claims arising from its use or maintenance of interchanged equipment or presence on the facility, with listed exceptions for the indemnitees' own negligence and certain equipment defects.

The endorsement shows a single limit for bodily injury and property damage arising out of interchange equipment and obliges the insurer to furnish a certificate to the Intermodal Association of North America (IANA) and to give IANA at least 30 days' notice of cancellation.

Who needs it

Port and rail drayage carriers and any trucker that picks up or returns equipment under the UIIA.

Quoting notes

  • Physical damage to the interchanged container or chassis is a separate exposure: trailer interchange coverage (CA 23 98, symbol 69 on the motor carrier form, or CA 23 30 schedule).
  • The current edition is 11 20 (Washington uses CA 23 26).
