What it does

CA 23 03 is a one-paragraph endorsement: under Covered Autos Liability, the vehicles described in its schedule are "mobile equipment" and not "autos". It modifies the business auto and motor carrier forms (the truckers form was struck in 2013).

Who needs it

Insureds whose vehicles serve both as transport and as working equipment and whose general liability policy is intended to cover them as mobile equipment, avoiding duplicate auto premium.

Key points

  • Vehicles subject to a compulsory or financial responsibility law where licensed or garaged are autos under the coverage forms' definitions, so states' motor vehicle insurance laws limit when this endorsement makes sense.
  • Confirm the CGL policy's mobile equipment definition and auto exclusion actually pick up the scheduled vehicles; otherwise the endorsement creates a gap.
  • The reverse approach, treating equipment-type vehicles as autos, is CA 20 15.

Quoting notes

Describe each vehicle precisely in the schedule and keep the CGL carrier informed. Coordinating both policies with the same carrier reduces disputes.
