What it does
CA 04 55 excludes Covered Autos Liability for damages arising out of the actual or alleged transmission of a communicable disease. The Massachusetts residual market manual lists it as the endorsement "to exclude damages for covered autos arising out of the actual or alleged transmission of a communicable disease." The 12 23 edition took effect December 1, 2023 in most states.
Who sees it
Accounts that carry passengers in close quarters, such as buses, vans, paratransit, ambulances and nonemergency medical transport, and social service agencies transporting clients. Insurers may attach it at their option.
Selling notes
- Claims alleging that a passenger caught an illness during a ride are excluded when this endorsement is attached.
- The general liability counterpart for auto dealers is CA 25 57; check whether the client's CGL carries a similar exclusion.
- Ask whether the insurer will remove it for operations with documented infection-control procedures.
