What it does
BP 05 96 is the broad electronic data liability option on the BOP. ISO describes it as coverage on a claims-made basis for damages because of loss of electronic data that is caused by an electronic data incident. A companion Extended Reporting Period endorsement (BP 05 97) provides a 3-year extended reporting period, and a separate endorsement (BP 18 06) can exclude loss of electronic data arising out of a cyber incident from this coverage.
Who needs it
Computer repair shops, IT service providers, electricians and low-voltage contractors, and other businesses whose mistakes could destroy or corrupt customers' data.
Quoting and selling notes
- Note the claims-made trigger: confirm the retroactive date and offer the extended reporting period at cancellation or non-renewal.
- Check whether BP 18 06 is attached; if so, hacking-related data loss is excluded.
- Many states use their own version (for example Alaska, Connecticut, New Hampshire, North Carolina, Oregon, Pennsylvania, South Dakota and Virginia).
