What it does
BP 04 17 adds an employment-related practices exclusion to Section II – Liability. It removes bodily injury or personal and advertising injury to a person arising out of refusal to employ that person, termination of employment, or employment-related practices, policies, acts or omissions such as coercion, demotion, evaluation, reassignment, discipline, defamation, harassment, humiliation or discrimination directed at that person, and the consequential injury to the person's spouse, child, parent, brother or sister.
Key provisions
- Applies whether the insured is liable as an employer or in any other capacity, and to obligations to share damages with others.
Who needs it
Attached by carriers that want to make the employment practices carve-out explicit. Employment claims belong on EPL coverage.
Quoting and selling notes
- Offer EPL: on the BOP through BP 05 89 where the carrier allows, or a stand-alone EPL policy (ISO EP program or carrier forms).
- Washington uses its own version (BP 04 60).
